Filing a DMCA Notice

To be effective, the DMCA notice must be in writing and include the following information:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  3. Contact information of the complaining party, such as an address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will take the following actions:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that we have removed or disabled access to the material.
  • Provide the user with information on how to file a counter-notice.

Counter-Notice

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notice with our DMCA Agent. The counter-notice must include the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. The user’s name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the user will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  4. A physical or electronic signature of the user.

Upon receipt of a valid counter-notice, we will promptly forward it to the original complaining party. If the original complaining party does not file a lawsuit within ten (10) business days of receiving the counter-notice, we will restore the removed material or cease disabling access to it.

Repeat Infringers

We reserve the right to terminate, in appropriate circumstances, users who are deemed to be repeat infringers.

Modifications to Policy

We reserve the right to modify this DMCA Policy at any time. Any changes will be posted on this page, and the effective date will be updated accordingly.
